These Terms and Conditions apply to all purchases made on www.togosunny.com (the ” Online Shop ”).

2. Prices, currency and product availability 🏷️
- All product prices are displayed in euros (€).
- Unless otherwise stated, prices exclude delivery costs, which are shown at checkout before payment.
- Each product page indicates whether the item is:
- In stock (shipped from Estonia) – short delivery times
- Pre-order / Made-to-order (shipped from West Africa) – longer delivery times
- Orders containing both types will normally be shipped together, unless otherwise agreed.
Worldwide shipping is FREE from €60 (subject to available shipping options for your destination).
Product descriptions (ingredients, materials, size, usage, etc.) are available on each product page.

3. Placing an order 🛍️
To order:
- Add products to the shopping cart.
- Select your delivery method.
- Add any promotional code.
- Click « Proceed to payment », accept these Terms, complete your details and choose a payment method.
Orders may be placed as a guest or as a registered customer. Registered customers receive a 5% discount on all regular-priced items (excluding discounted or promotional products).

4. Payment methods and payment security 💳
We offer the following payment methods:
• Credit/Debit Card Payment (Stripe)
You can pay with Visa, Mastercard, American Express and other supported cards.
Payments are processed securely by Stripe, a PCI-DSS-compliant payment processor.
TogoSunny does not store any card details.
• Bank Transfer (Prepayment)
Your order is processed after the payment reaches our account.
Bank transfer instructions are provided at checkout.
• Estonian Bank Payments (EveryPay)
For customers in Estonia, we offer bank payments via EveryPay, supporting banks like Swedbank, SEB, LHV, Coop Pank, etc.
You are redirected to your bank’s secure environment.
🔒 Payment Security
- All transactions use SSL/HTTPS encrypted connection.
- Card details or data is stored by TogoSunny.
- Stripe and EveryPay comply with PSD2 and SCA.
The sales contract is concluded once the full amount has been received or the payment has been authorised.
If a product cannot be delivered (out of stock, discontinued, or any other reason), we will notify you and refund all related payments within 14 days.

5. Delivery 🚚
Delivery costs are shown at checkout. Shipping is FREE from €60.
We ship orders on working days.
Delivery times depend on whether the product is in stock in Estonia or a pre-order shipped from West Africa.
a) In-stock products – shipped from Estonia (short delivery times)
- Estonia: 2-5 working days
- Finland: 2-5 working days
- Other countries: delivery time varies depending on carrier and destination (estimate shown at checkout)
b) Pre-order / Made-to-order products – shipped from West Africa
- 15-25 days depending on route, customs, and production time.
You will receive an e-mail confirmation when your order is shipped or ready for pickup, including tracking if available.
Packages must be collected from parcel machines/pick-up points within the storage period indicated by the carrier.

6. 14-Day right of withdrawal (Returns)
Consumers have the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason.
This right does not apply to legal persons (companies/organisations).
Products may only be handled to the extent necessary to determine their nature, characteristics and functioning, similar to a physical shop inspection.
If a product has been used beyond what is necessary for such inspection and its value is reduced, the refund may be proportionally reduced. You can exercise your right of withdrawal by sending the completed EU Withdrawal Form, available here: RETURN AND REFUND POLICY
Exception – sealed products (food, cosmetics, health products)
For health and hygiene reasons, the right of withdrawal does not apply to sealed goods that are not suitable for return once opened after delivery.
(This includes certain food products, cosmetics, and personal-care items.)
The exception does not apply if the product is defective or incorrect.
To withdraw, you must submit a withdrawal form (RETURN AND REFUND POLICY) to klientservices@togosunny.com within 14 days of receiving the goods.
The customer bears the cost of return unless the item is incorrect, defective, or damaged.
Goods must be returned within 14 days of submitting the withdrawal form, or proof of shipment must be provided.
Refunds will be issued within 14 days of receiving the returned goods or proof of return.
Refunds are made using the same payment method unless otherwise agreed.
The Online Shop may cancel the sale and request the return of goods if the displayed price was significantly incorrect due to a technical error.

7. Complaints and non-conformity
We are responsible for any defect or non-conformity that existed at delivery and becomes apparent within 2 years.
If the defect appears within 6 months, it is presumed to have existed at delivery, unless proven otherwise.
The consumer must notify us of any defect as soon as possible, and within 2 months of discovery.
We are not responsible for defects caused after delivery by misuse, improper storage, or normal wear.
If goods are defective, we will repair, replace, or refund them if repair/replacement is impossible within a reasonable time.
We respond to complaints within 15 days.

8. Services (Workshops, Events, Performances)
For services provided on a specific date or period (events, workshops, guided tours):
Cancellation rules (deadlines, fees, etc.) are indicated on each service page or during booking.
Once the service is fully performed, the right of withdrawal may no longer apply.

9. Personal data and direct marketing
Personal data is used only for order processing, delivery, and customer service.
Data may be shared with logistics partners when necessary for delivery.
Marketing e-mails are sent only with explicit consent, and can be cancelled anytime via the unsubscribe link or by contacting us.

10. Dispute resolution

If no agreement is reached, the consumer may contact the Estonian Consumer Disputes Committee.
For cross-border disputes within the EU, consumers may use the EU Online Dispute Resolution (ODR) platform.
